Lawyers in the Jagdeo/Kissoon libel case are awaiting a decision by presiding Supreme Court Judge, Brassington Reynolds, on the amendments to the defence case.
These amendments were submitted by Attorney -at -Law, Nigel Hughes, yesterday.
Lawyers for Bharrat Jagdeo (Senior Counsel Bernard De Santos and Sase Gunraj) have objected to the changes. The judge’s is scheduled for March 24.
Hughes is representing Kaieteur News columnist, Frederick Kissoon, who is being sued by the former Head of State for in excess of $10M for libel.
Also sued are Editor in Chief Adam Harris and Publisher Glenn Lall.
The former president took legal action against the columnist, who wrote that Jagdeo practised “ideological racism”. The comments were contained in an article titled King Kong sent his goons to disrupt the conference.
Based on the evidence that the latest witness for the defence was giving, the issue of justification was raised. Senior Counsel De Santos felt that the defence was making statements that could not be supported.
He said that there are no particulars of general assertions which provided the defence with the right to lead certain evidence in the matter and as such asked that the defence provide evidence to support their claims.
Hughes had told the court that the defence was tasked with proving the statements made against the former president. He argued that this was being done based on the research which was conducted by the defendant and the evidence given by the witnesses.
He said that the case for the defence is a plea of justification, and in doing so, witnesses are being called to speak on the areas of public/social services where “ideological racism” was practised.
The attorney is seeking to amend his case to specifically deal with the issue of justification.
