The family of accident victim Lovina Tull and relatives of the driver accused of causing her demise while driving drunk last February, are attempting to reach a financial settlement that should result in all charges being dropped against the accused.
An attorney for 25-year-old pickup driver, Hafraz Mangru, has confirmed that both parties are trying to reach a settlement, and this was confirmed yesterday by a relative of Tull.
However, Kaieteur News understands that while Tull’s relatives are seeking some $6.5M in compensation, Mangru’s relatives have indicated that they are unwilling to give the family more than $2M.
Mangru is reportedly scheduled to reappear in court on March 25, and both parties hope that a settlement is reached by then.
Lovina Tull, of Melanie Damishana, East Coast Demerara, had just left work at the City Holiday Inn, located at Liliendaal, at around 21.30 hrs on February 5, when a pickup, allegedly driven by the accused, struck her. She was hurled into the Ocean View Hotel’s compound.
Hafraz Mangru, of Lot 176 Sparendaam (‘Pradoville 2’), East Coast Demerara, was charged with causing death by dangerous driving and driving under the influence. He was also fined $75,000 after pleading guilty to driving an unlicenced vehicle. Police allege that he was found to be 200 percent over the allowable alcohol consumption limit for motorists.
The accused was remanded during his first court appearance but was subsequently released on bail.
Over the years, the relatives of fatal accident victims have opted to seek financial settlements rather than go through with lengthy court cases.
In January, 2012, relatives of security guard, Ronville Roberts accepted a $2.5M settlement from truck driver Sahid Ali, who was accused of causing Roberts’s death in an accident on the Soesdyke/Linden highway.
The 29-year-old driver was on charges of causing death by dangerous driving and failing to render assistance. The accused had made an initial payment of $200,000 to the dead guard’s family, and, in the presence of a magistrate, handed over a further $500,000 to the dead man’s reputed wife, Ingrid Schmidt.
Ali, who had been placed on remand, was then released on $100,000 bail. The matter was then dropped.
Other ‘compensation packages’ to families have ranged from $5M for the death of a young mother, $600,000 for the death of an eight-year-old girl, and $300,000 for a seven-year-old girl killed on a pedestrian crossing.
All the accused drivers were before the courts on causing death by dangerous driving charges.
