David and Thom, his alleged accomplice, are on trial for the murder of Lakhram Bishundial, the witness’s older brother, which occurred on August 20, 2010 at Hope, East Coast Demerara.
While giving his sworn evidence, Bishundial pointed to the two persons sitting in the dock, (Thom and David) identifying them several times as the men who participated in the crime which led to his brother‘s death, in response to questions by State Prosecutor Judith Gildarie Mursalin.
He told the court that on August 20, 2010, he had left his home in De Hoop, Mahaica for Georgetown to do some shopping for his wedding which was scheduled for the upcoming weekend.
According to the witness, his cousin ‘Seeta’ also accompanied him to Georgetown, where he went to the bank and withdrew $500, 000 before returning home.
On his way to Mahaica, the witness recounted that he saw his brother at Hope Canal.
According to Bishundial, he had stopped for a few minutes at “Hope Turn” to chat with his brother, Lakhram, when a Negro man walked up him.
The man, he said, pulled a gun from his waist and pointed it to his chest.
“He said gimme de bag wid de money.”
At this point, Bishundial said that he placed both hands his in the air and began backing away from the gun, his brother who was seated in the driver’s seat of the truck said something and the gunman turned and fired a shot insid the truck.
The witness said he heard his brother “holler” before he ran and jumped in into the Hope canal. He claimed that he came up from the canal and saw another man on a motorcycle, whom he identified to be Thom, and the gunman (David) leaving his pickup truck with a bag.
He said that the next time he saw David was at Guyoil Gas Station at Victoria, as he was taking his injured brother to the hospital. He tried to pin the man to a nearby fence but the suspect escaped in a white motorcar with licence plate number PJJ 6855.
Several hours later his brother was pronounced dead at St Joseph’s Mercy Hospital.
The next time Bishundial recalled seeing the accused was during two separate identification parades. He is currently under cross examination by Defense Counsel Trenton Lake and George Thomas. The trial will continue on Monday.
