Dear Editor,
I am going to have to repeat my previous submission, since in related matters it is not being applied and I believe that it should. Our constitution tells us at Article 9 that “Sovereignty belongs to the people who exercise it through their representatives and the democratic organs established by or under this constitution”
I now refer to another letter from Sultan Mohamed in the letters column of the Stabroek News dated 7th Feb. 2014 captioned “Where has the President violated the constitution in declining to assent to bills?” Again Mohamed has penned a lot of drivel.
For the moment, I will depart and give an example of sovereignty belonging to the people and the consequences of not acknowledging it. King Charles 1 of England, Scotland and Ireland fought the armies of the English and Scottish parliaments in the English Civil War. After his defeat in 1645, he surrendered to a Scottish force that eventually handed him over to the English Parliament.
Charles refused to accept his captors’ demands for a constitutional monarchy, and temporarily escaped captivity in November 1647. Re-imprisoned on the Isle of Wight, Charles forged an alliance with Scotland, but by the end of 1648 Oliver Cromwell’s New Model Army had consolidated its control over England. Charles was tried, convicted, and executed for high treason in January 1649. The monarchy was abolished and a republic called the Commonwealth of England was declared
“All of this happened because Charles quarrelled with the Parliament of England, which sought to curb his royal prerogative. Charles believed in the divine right of kings and thought he could govern according to his own conscience. Many of his subjects opposed his policies, in particular to but not limited to the levying of taxes without parliamentary consent, and perceived his actions as those of a tyrannical absolute monarch.”
At the end of this matter sovereignty of the people was established in British common law which informs our constitution today.
In this country we have a President who is refusing to assent to Bills made legal by the Guyana Parliament, which wereput forward by the opposition which holds the majority of the seats and as such are clearly expressing the wishes of the majority of the people in this country, who are empowered and mandated by the constitution to hold real sovereignty.
By not assenting to their wishes, he is doing exactly what Charles 1 did and is violating the very constitution he has sworn to upholdby his oath of office.
Let me make this clear, he is not withholding his assent on one Bill because he has legitimate and serious objections to it, he is withholding his assent to all of them because he maliciously wants to remove the sovereignty of the people by depriving them of their wishes as expressed by their representatives who hold the majority of the seats in the parliament.Since he wrongly believes that he holds absolute sovereignty in this country and not the people.
He is doing exactly what Charles 1 did for which he was tried for treason and executed.
Subject to the opposition and the people’s interpretation of these thoughts, it is left up to them to decide if they will ask the Guyana Defence Force to enforce the constitution by whatever means they have at their disposal.
President Ramotar must understand that he cannot rely on an inexperienced Attorney General Nandlall to navigate him through these narrow and dangerous waters.And I want him to know that I as a citizen of this country who voted in the last election can step in and take legal action against him and so can any other citizen.
