A city magistrate yesterday deemed that murder accused Joshua Payne is presently unfit to stand trial over accusations of a stabbing to death of a gold trader which occurred in the vicinity of Stabroek Market over two years ago.
Payne, who has been in remand ever since December 2012, appeared once again at the Georgetown Magistrates’ Court, on account of the capital offence.
It is alleged that on December 19, 2012 at America Street, he murdered 42-year-old Kelvin Caines of Lot 236 Lodge Housing Scheme, Georgetown.
At yesterday’s hearing, a psychiatric evaluation was presented to Magistrate Fabayo Azore by Psychiatrist Dr. Bhiro Harry.
Dr. Harry told the court that since Payne was ordered in psychiatric care he has been cooperating fully with officials. He added that whilst there had been improvements in his mental condition, there are still moments where he relapses.
“There are moments when he is delusional. At times he calls on the Crown, Queen and Euros.”
The specialist made a suggestion to the court that “He is much improved, but he is not fit to stand trial.”
The Doctor doubted whether Payne’s utterances are proper and added that he could benefit from more treatment.
Dr. Harry requested that Payne remain at Camp Street where he can easily access him to further his treatment.
After listening to the report, the Magistrate indicated that Payne is unfit to stand trial and engaged him in a conversation. She encouraged him to continue with his treatment.
Payne’s case is currently being prosecuted by Inspector Stephen Telford. The presiding Magistrate indicated to the prosecution that she would have to consult with the Chief Magistrate before she can proceed.
At present, the matter stands adjourned until a date is determined, and Payne was further remanded.
Previous reports indicate that at around 03:00 hours on December 19, 2012, Caines died shortly after he was stabbed under his arm.
Caines, a father of two, was allegedly sitting at one of the gates at the Stabroek Market, conducting gold business when Payne allegedly approached him with a knife and stabbed him and escaped.
Caines reportedly died while receiving treatment at the Georgetown Public Hospital Corporation. Payne was later apprehended and the murder charge was later instituted against him.
