Dear Sir,
I refer to certain points put forward by the Honorable Justice Kennard. I was called on the 13th January to an Election meeting been held at his track and clearly remembered saying to Mr. Fazal Habibulla and members of the Ryan Crawford Turf Club (RCMTC), that I was legally advised that the current structure of the Guyana Horse Racing Authority (GHRA) is not in keeping with the required standard for supervising Horse Racing in this country, for documents signed by us and registered at the Deeds Registry made us as individuals, liable personally, in event the authority finds itself being sued by any Horse Owner/s for sanctions imposed by the body, as such I would not put my little assets to risk in event of same.
The selected member’s were also advised, until the passage of legislation it’s just a gentleman’s agreement that we are operating with. As such we have to consult the horse owners, trainers and jockeys to work with the only established Demerara Turf Club rules until the passage of the legislation.
This nonsense of petty finger pointing with regards to dates issued to clubs is not worth my precious time, since it was dealt with already. However, it appears that the learned Judge forgetting things quickly. Just remember his track the KMTC held a Digicel meet in August-his original date was Sunday 4th, it was arbitrarily changed to the 1st which was Emancipation day. It was changed again, a few times reasons being, emancipation clashing with his dates. It was held on the 11th August and threw the RSTC race meet set for the 18th off.
It’s the same with the Ryan Crawford and Sheriff Racing Stables race meeting – car Racing and the Berbice Regatta on the 24st and the 1st respectively. As such some of the sponsors just like Digicel asked to make the said adjustment to accommodate them. Another point in contention is, the Rising Sun Turf Club ran off an unauthorized PPP race meet on the 5th October, was that date agreed upon at their so called race date meeting? Didn’t that meet affect the Bush Lot United Turf Club meet which was agreed to by him for 29th September, 2013? My learned friend seems to forget these things so easily and quickly.
For three years now the New Year’s meet was cancelled due to heavy rainfall, must the horse owners sit and wait again on the weather? The organizer of that meeting was told that we the horse owners need to feel comfortable that the meeting will be held this time rain or shine at his venue or at the Port Mourant venue. So we need to see a programme reflecting same, was this done, the answer is no. So now we have this confusion.
In closing I would like to ask the learned Judge if my signature was affixed to a document agreeing to certain guidelines, that we all should follow and adhere to, isn’t it dishonest to alter that document without full consultation with the signatories of that document.
