Finance Minister, Dr. Ashni Singh, has tabled an amendment for the Procurement Act, meant to preserve the Cabinet’s ability to give a ‘No Objection’ to the award of large contracts.
This amendment Bill is expected to be debated and voted on at the next sitting of the National Assembly.
Government is looking to have the change effected in the law, before establishing the Public Procurement Commission.
Under the existing Law, with the establishment of the Public Procurement Commission the role of Cabinet would be phased out.
Speaking at the Office of the President yesterday, Head of State, Donald Ramotar, told media operatives that it could be misunderstood that Cabinet wants a role in to award contracts.
Ramotar said, “All the Cabinet is asking for is to have a ‘no objection’ to any contract or procurement that is awarded.”
This, he said, is based on the principle that “we are the ones that are answerable and we are to be held responsible.”
As a result, he said, that at the very minimum Cabinet needs to be able to have the ability to offer a no objection.
The President was adamant that there is no other country in the world where this is not the case.
Ramotar added that the change to have the Cabinet role removed was not instituted by the then Cabinet, but rather on the floor of Parliament when it was debated and approved several years ago.
He said that the government’s position is grounded in principle and pointed to the fact that agencies with which it would collaborate for projects such as the Caribbean Development Bank, the IDB and the World Bank among others, would also seek to have a ‘no objection’ in the award of contracts.
“All of them have to give a ‘no objection’ before any contract is awarded…we are moving on this thing in a very principled position…We don’t think that it is unreasonable.”
