After witnesses and the officer who instituted the charge continued to be a “no-show,” the presiding Magistrate was forced to dismiss the charge of noise nuisance against Seeta Gursahai, proprietor of Seeta’s Bar in Station Street, Kitty.
The charge was instituted after residents made several reports at the Kitty Police Station about the loud music at a Phagwah Day event that was held at the popular bar.
According to police reports, the residents stated that they experienced a lot of discomfort due to the loud music and added that the owner shows no regard for their complaints.
When Gursahai first appeared before Chief Magistrate Priya Beharry, she was granted bail to the tune of $15,000 and the matter was transferred to the court of Magistrate Geeta Chandan-Edmond.
When the matter first called before Magistrate Chandan-Edmond, it was adjourned due to the absence of seven to eight witnesses.
Yesterday, for a second time, the witnesses, who claimed they wanted relief against the owner who was charged for the said offence, once again were no-shows.
Given the circumstance, the Magistrate had no choice but to dismiss the case.
The matter, it was stated, was thrown out due to lack of prosecution; witnesses being no-shows and the absence of the officer who was instrumental in placing the matter before the court.
