A teenager who barged into a juvenile’s home and raped her six years ago is on trial in the High Court for the offence.
When the matter began on Friday in the Berbice High Court, Leon Mickle, called “Eon”, 23, of Angoy’s Avenue, New Amsterdam, Berbice, appeared before Justice Dawn Gregory and a mixed jury to answer to the charge of carnal knowledge committed back in 2007.
The court was told that on July 15, 2007, at Angoy’s Avenue, New Amsterdam the man engaged with sexual activity with a girl who was said to be 12 at the time. She was at home in the bedroom sleeping when she was awakened by the perpetrator who had sex with her.
Addressing the jury in her opening statement Prosecutor Dionne Mc Cammon asserted that the state only has to prove penetration. She said that the girl could not give consent because she was not of age.
The state also called its first witness, detective Corporal Chaitanand Singh. The policeman said that the virtual complainant and the accused who was 17 at the time were known to each other. He told the court that on July 16, he held a confrontation between the accused and the virtual complainant during which the girl repeated her story. She also said that the man offered her $2,000.
She refused and he proceeded to push her on the bed and forcefully had sex with her.
The matter was reported to the police and the accused was arrested and charged. A medical examination was also done on the virtual complainant. Her birth certificate was also tendered as evidence.
Attorney at law Sasha Roberts of the legal aid clinic who is representing the accused then asked for an adjournment since she was only retained yesterday morning.
The case was adjourned to Tuesday at 13:30 hrs.
