Twenty-nine year-old murder accused Abdulssalam Azimullah called ‘Sato’ of 183 Hampshire, Corentyne, Berbice and Nigg Squatting Area, also in Corentyne, who is charged with the December 2004 murder of Gary Simon at Nigg Settlement, was yesterday remanded to jail by Magistrate Fabayo Azore when he appeared before her at the Albion Magistrate’s Court on the capital offence.
It is alleged that Azimullah was in the company of two other men, Ghansham Jagassar, 31, of 60 Squatting Area, Williamsburg, Corentyne and Davendra Harricharran, 24, called ‘Bara’ of Nigg Squatting Area when he allegedly committed the act in a rum shop.
They were arrested and charged and after a Preliminary Inquiry was conducted at the Albion Magistrate’s Court, they were committed to stand trial for manslaughter in the High Court and granted bail. The DPP subsequently reviewed the case and ordered that the men be committed for murder. However by that time Azimullah could not be found. His two accomplices were subsequently tried and had the charges against them dismissed after no-case submissions were presented by defence counsel Kim Kyte-John and Vic Puran on the ground that the committals and indictments were bad in law.
The two men were immediately ordered re-arrested and went through a second Preliminary Inquiry before Magistrate Azore at the Albion Court. They secured the services of Attorney Kim Kyte-John, and the matter was subsequently discharged.
In the meantime Azimullah was on the run, during which time he committed a number of misdemeanours and was recently nabbed after committing a robbery.
He has been charged with the murder committed on Saturday 18th December 2004. He is accused of murdering Gary Simon.
He was recently nabbed with others in a house at East Bank Berbice after they allegedly robbed a couple while armed with AK-47.
He was unrepresented and will have to return to court on July 24.
The state’s case is that on the day in question, Simon and his reputed wife, Annette Samaroo, and a friend Rama, were sitting in Red Rose Bar, at Nigg Settlement, Corentyne. The accused men were in the vicinity imbibing alcoholic beverages, and sometime during the interim the mortal wounds were inflicted on the deceased
Simon, who was a cane harvester, was rushed to Port Mourant Hospital, before being transferred to New Amsterdam Hospital where he died the next day.
A Post Mortem examination conducted by Dr. Vivikanand Brijmohan showed that death was due to shock and haemorrhage and incised wounds.
