The Preliminary Inquiry (PI) into the death of 16-year-old Neesa Gopaul continued yesterday.
Her mother, Bibi Gopaul and her lover, Jarvis Small are accused of murdering the Queens College student in October 2010 and the pre-trial hearing is currently before Chief Magistrate Priya Sewnarine-Beharry. The state is represented by Prosecutor, Pritima Kissoon.
The first witness of the day, Phillip Matthews, a Justice of the Peace (JP) and a Commissioner of Oaths told the court of his interactions he reportedly had with the persons involved in the matter.
According to Matthews, he reportedly drew up documents for Bibi Gopaul refuting an alleged statement given to the police by her daughter pertaining to Small. He related the contents of the document and what it represented.
The two accused refused to cross examine the witness in the absence of their lawyers. On the last few occasions, Senior Counsel Bernard De Santos had been absent. The lawyer had indicated to the court that he was severely ill and it was unsure when he could return. He is representing Small. Puran on the other hand who is representing Gopaul, was also absent but had informed the court.
Also giving evidence was a police photographer, Corporal Lancelot Whittington. The police told the court that he is stationed at the Criminal Investigations Department (CID) attached to the Crime Laboratory. He further related his activities during the investigation into the teen’s death. He reportedly took pictures purporting to be that of the deceased at the mortuary of the city’s public hospital.
This photographic information was presented in court and shown to the accused. Gopaul broke into tears after seeing the photos of the dead girl. Small declined to view the images.
The accused, however, declined to cross-examine the police photographer.
Last in the witness box for the day’s hearing was Police Constable, Ryan Leacock, who said that he is attached to the Leonora Police Station Anti-Crime Squad and had had played a part in the investigation of Gopaul’s death. He was attached to the Inquires Office. Leacock reported to the court that he allegedly arrested Small and what he had done during and after the arrest.
Again cross examination was declined by the two accused. Re- examination was also refused. The court hearing will resume today and more witnesses are expected to testify.
The two persons are accused of the murder of the teen whose body was found on the Soesdyke/Linden Highway in 2010 stuffed inside a suitcase. The body was reportedly found partially submerged in a creek near the Emerald Tower Resort. Two dumb- bells were found attached to the suitcase with ropes, in an apparent attempt to weigh it down.
