Tortola, VI (www.virginislandsnewsonline.com)- A chef, who works at a popular establishment, has been accused of allegedly raping a waitress.
Oswin Barker, 37, of East End, Tortola allegedly committed the act sometime between March 21 and March 22, 2012 at Brandy Wine Bay beach.
The defendant appeared in the Magistrate’s Court at John’s Hole on Monday where he was not required to plead to the indictable matter. However, he was granted bail in the sum of $75,000 by Magistrate Tamia Richards- $15,000 is to be deposited in cash along with two signed sureties.
Barker had allegedly taken the VC and her friend to a bar in Long Bush, after which he reportedly took the VC’s friend home but drove past the VC’s area of residence and proceeded to Brandy Wine Bay despite the alleged disapproval of the VC.
The VC, the court was told, allegedly asked the defendant where he was going and he reportedly told her he wanted to speak to her. She also reportedly told the defendant, who is from Guyana but has been living in the VI for five years, to take her home since she was sleepy and tired.
Prosecutor Sarah Benjamin also said Barker allegedly told the VC how much he liked her and if she couldn’t see that. He also reportedly told her that he would do anything for her and that’s why he and his girlfriend were not presently on good terms.
During the alleged rape, the VC reportedly punched the defendant in his face and bit him in his chest.
The Crown also alleged that the defendant, when told of the allegations, said to police, “Me not me officer, I never raped that girl” but did claim to having sexual intercourse with the VC on more than one occasion and further claimed “she was his girlfriend”.
Barker’s lawyer, Stephen Daniels, said his client totally denies the charge of rape and they intend to “vehemently” defend against the charge.
Both the Crown and the defence will be seeking to acquire phone records of communication between the defendant and the VC to tender into evidence.
The Crown did not object to bail but asked that the defendant stays away from the VC and desist from any type of communication with her. Barker is to also turn in his travel documents to Police and report to them periodically.
The matter will be called again on April 30, 2012 for report.
