Herman Ally, called ‘Shark Oil’, 63, of Rose Hall Town, Corentyne, who is accused of murdering fellow Rose Hall Town resident, Randal Sandy, who was 41 at the time, was committed to stand trial.
Sandy lived at Sabsook Street, Rose Hall Town. The killing occurred some time between October 5th and 6th, 2006. Ally is on trial before Justice Brassington Reynolds and a mixed Jury in the Berbice High Court.
The jury was empanelled on Tuesday but state appointed attorney, Raymond Ali, had asked for a two-day adjournment to get himself acquainted with the case.
In court on Thursday, State Prosecutor, Attorney at law, Zamilla Ally, related the case for the prosecution. She said that on October 5, about 16:00 hrs the deceased, Sandy, was seen with a wound in the vicinity of Ally’s yard. He was picked up and taken to his mother’s home a short distance away before being rushed to the New Amsterdam hospital. He died the next day.
Ally was arrested the following day and charged with the murder.
In court the state called one witness, Cisley Brusch, the mother of the deceased who stated that on the day in question, her son, who works at the market, came home, had his lunch and went out. He did not tell her his intended destination.
She stated that she was at home about 4pm when she received some information that caused her to hurry out of the house, to the street where she saw her son lying on the ground.
The injured man was picked up and taken to her home. She said that she hired a car and rushed him to the New Amsterdam Hospital where he was admitted. She subsequently got a call from the hospital about his demise.
She said that she had known the accused for about 10 to15 years. He lives not too far from her and was her son’s friend. She knew of no problems that they had, she said.
It is understood that the accused and a woman had a misunderstanding and he cuffed her in her face. ‘Shark Oil’ then left and went into his yard and armed himself with a knife and came out and took up a position in front of his yard.
Not long after Sandy was passing on his bicycle and told Ally that he was taking advantage. With that Ally rushed at Sandy and stabbed him in his left side abdomen.
Sandy subsequently collapsed and was rushed to the New Amsterdam hospital, where he died the following day.
A preliminary inquiry was conducted by Magistrate Tajenarine Ramroop at the Albion Magistrate’s Court and a prima facie case was made out.
