Submissions are underway before Justice Franklin Holder, who is conducting a voir dire to determine the admissibility of caution statements attributed to murder accused; Satnanand Sahadeo called “Boyso.”
Sahadeo and his co-accused, Peter Ray Kassim called ‘Donkey’ have been on trial for more than three weeks now for the murder of 34-year-old Vishnu Santie which occurred on June 29, 2005, at Stewartville Pasture, West Coast Demerara. Sahadeo is being represented by Attorney-at-Law George Thomas while Kassim’s lawyer is Hukumchand.
During the presentation of the Prosecution’s case by State Attorneys Judith Gildharie-Mursalin and Renita Singh, Thomas objected to caution statements allegedly given to police officers by Sahadeo on 27th October, 2005, while he was in custody at Vreed-en-Hoop Police Station.
Following the objection, the voir dire (a trial within a trial) was convened by Justice Holder in the absence of the jury. The prosecution called eight witnesses to testify in this smaller trial, namely, Inspector Joel David, Assistant Superintendent of Police, Hugh Jessamy, David Boucher, Superintendent of Prisons, Phillip Bandoo, Assistant Superintendent of Prisons Sherlyn Crossman, Prison Officers Sharon Seopaul-Edwards and Dawn Goodman, as well as Corporal Doodnauth Bridgemohan.
Following the closure of the prosecution’s case, Sahadeo gave an unsworn statement from the dock in his defence and called no witnesses. Thomas then made submissions to the Trial Judge, after which Gildharie-Mursalin commenced the State’s submissions which will continue today.
The State’s case before the Jury is that Vishnu Santie was shot seven times in a failed robbery attempt as he climbed the stairs to his home on the night in question. The trial is continuing.
