Attorney- at-law James Bond yesterday learnt that the matter of damage to property which was discharged against him earlier this month before Magistrate Hazel Octive- Hamilton was reinstituted.
Bond who yesterday faced Chief Magistrate Priya Sewnarine- Beharry as the defence for a client, was surprised to know that the matter which was reported by Adrian Wilman, the complaint, was back in court.
According to Bond, to his knowledge, the matter against him had been dismissed and no date was given for him to return to court. He claimed that he was entirely oblivious to the fact that he was to reappear in court and that a summons had been served for him.
The court informed Bond that the matter against him will be called on January 30 after police sent back the court file.
On January 11 Bond faced the Court on three charges that included assault causing actual bodily harm, damage to property and threatening language.
He allegedly destroyed Adrian Wilman’s property and threatened Rawle Stephens, Wilman’s friend. When the parties appeared in court, the defendants refused to give evidence against Bond who was represented by Attorney Patrice Henry.
In a surprising twist, Rawle Stephens told the court that he had never made any claims against Bond. He said he had only gone to the police station to be a witness on behalf of his friend. When he faced Magistrate Hamilton, he learnt that he was a complaint in the matter.
In another surprising revelation, a police woman who had appeared to swear to the evidence presented to the court claimed that she was set up. The female rank said that she was not aware of any damage to property charge and was told by superiors to just swear to the information.
The woman thereafter claimed that it would be against the law to swear to the information since she did not institute any charges. The police were told by the court to go and come again when their facts were right.
