In a letter to the Minister of Sport by Attorneys, Sanjeev Datadin and Navindra Singh of Whitworth Chambers Law Firm, the lawyers called for the interference in the cricket standoff by the government should cease.
The Lawyers pointed to the fact that the cricket board office is on private property and the government and minister as a public official are obliged to act in a manner in accordance with rule of law. The letter noted that actions of the ministry constitute a trespass to the GCB’s property and an unlawful and arbitrary interference with their business and assets. The letter further stated that those actions constitute clear misconduct in public office, which conduct could render the minister liable in both a criminal court and a civil court.

Honourable Minister,
I am retained to act in association with Sir Fenton H. W. Ramsahoye S.C. by the Guyana Cricket Board, (GCB) a private entity engaged in the administration of cricket in Guyana.
We are instructed that on the 27th December, 2011 you caused your agent the Permanent Secretary in your Ministry to put padlocks on the offices and bond of the Guyana Cricket Board (GCB).
We are obliged to inform you that the GCB’s office is located on private property and that our client is in fact a private entity which operates in full compliance with all the laws of Guyana. Further, we are obliged to inform you that as a public official you are obliged to act in a manner in accordance with rule of law.
Be advised that your conduct and that of your agents are unlawful. The taking over of a private entity to which the Government makes no financial contribution is contrary to the principles of a democratic State and repugnant to law. Your actions constitute a trespass to my client’s property and an unlawful and arbitrary interference with their business and assets. Further, your actions constitute clear misconduct in public office which conduct could render you liable in both a criminal court and a civil court.
We do hereby respectfully request that you immediately cease and desist from the interference with my client’s activities and permit them to carry out their functions as the recognised administrators of cricket in Guyana. Failure to comply with this notice will leave my client with no option but to seek the guidance of the Courts to save their assets and protect the cricketers in Guyana. A response from you is preferred as a matter of urgency so that it may be exhibited to Court proceedings which may result from your actions.
Be advised that my client fully reserves it rights to take proceedings in any event.
