Dec 16, 2011 Letters
Dear Sir,
Some time ago, the Guyana Human Rights Association (GHRA) issued a Press Release calling for an independent investigation into how the three Managers of NBS came to be charged in the first place without any evidence.
Such an investigation, according to the GHRA, will begin to restore much needed faith in the judicial process. This call has remained unheeded thus far.
From the inception of the charges against these men on 1 June, 2007, there has been a public outcry for an investigation as never before in the history of this country.
In Wednesday’s edition of your newspapers dated 7 December, 2011 there appeared a letter written by a concerned member of NBS. The contents of the letter, if true, appear to lead to a conspiracy.
There has been no response to the numerous letters which appeared in the press on this matter as there seems to be a conspiracy of silence.
The careers of these men have been destroyed and they need our help. I am therefore calling on the joint opposition to use their parliamentary majority in Parliament when it convenes to approve an enquiry to get to the truth.
I am sure they will get the support of at least the new Minister of Labour if his post-swearing in statements on justice and fairness are not meant to deceive.
C Gonsalves.
Editor’s Note: Since the publication of the previous letters, lawyers for New Building Society have written to this newspaper. We publish that letter.
Dear Sir,
We write on behalf of our clients, the New Building Society Limited. We refer to the reports and letters in your editions of Friday, 21st October, 2011 headlined “GHRA calls for acquitted NBS managers to be compensated”, Friday, 28th October, 2011 headlined “The GHRA and the NBS saga” and “The DPP and the NBS Board must be investigated” Wednesday, 16th November, 2011 headlined “President Jagdeo and NBS Directors must comment”, Wednesday, 23rd November, 2011 headlined “The end of the rope” and Friday, 25th November, 2011 headlined “Truth will prevail”.
The first report of 21 st October, 2011 extensively cited a statement issued by the Guyana Human Rights Association (GHRA) in which the GHRA called on our client, the New Building Society Limited, to pay all benefits due to Maurice Arjoon, Kent Vincent and Kissoon Baldeo, the former chief executive and senior officers of the Society, the charges against whom have been dismissed. The letters also make the same demands. They all seem orchestrated.
Three court actions instituted by Messrs. Maurice Arjoon (Action No. 2010/219W,Demerara), Kent Vincent (Action No. 2010/243W,Demerara) and Kissoon Baldeo (Action No. 2010/222W, Demerara) are pending in the High Court in relation to the benefits claimed by them.
The cases are being contested by the New Building Society Limited.
We should like to point out that negligence in civil proceedings can be proven even though there might be no criminal liability for the same act or acts or omission or omissions.
In the circumstances, it is highly inappropriate and sub judice for reports and letters such as those referred to above be published in you newspaper which can prejudice the outcome of the proceedings.
Such publications can also constitute a contempt of Court.
We have been instructed by the New Building Society Limited to request that as all reputable newspapers do, you desist in future from reporting any prejudicial statements or other material in connection with these matters.
Cameron and Shepherd
