A man accused of having carnal knowledge with a 12-year-old on three occasions is currently on trial before Justice James Patterson at the High Court.
Charged with the offence is Carl Alleyne Wren.
Prosecutors Judith Gildharie-Mursalin and Teshana James-Lake are representing the state while attorney at law Adrain Thompson is standing for Wren. As the matter continued yesterday morning one of the jurors had to be excused after he informed the court that he knew a relative of the victim. The trial will now continue with 11 jurors.
The allegation before the court is that Wren between October 1 and October 31, 2003, had carnal knowledge of a 12-year-old girl.
The second charge stated that between November 1 and November 30, 2003, he had carnal knowledge of the same female.
And the third charge stated that Wren between February 1 and February 29, 2004, again had carnal knowledge of the child.
The court was told that the defendant lived with the victim’s cousin and their one-month-old baby, a short distance away.
The young child was a frequent visitor to the home, and on the first occasion Wren allegedly called the child over “to do something”.
It is alleged that when the child entered the house, Wren told her to sit on a bed.
Once seated Wren allegedly started showing the child pornographic pictures.
After realizing what was happening the young girl tried to run away but Wren grabbed her by the waist and raped her.
The court was told that the girl held onto the door frame, but was overpowered by the defendant.After the ordeal the child went back home.
Sometime during the month of November 2003, the second incident occurred.
Like the first occasion, the victim was called over and overpowered, then raped.
On the last occasion, which was sometime in February 2004, the defendant told the victim that her cousin was calling her.
When the young child went over to the house, her cousin was not there and she tried to run away, but was subdued and raped for a third time.
It was not until July 2005 that the child summoned up the nerve to tell her mother what had happened.
She was immediately taken to the station where she was examined. After that the child, her mother and father were heading home when they saw the defendant. There was a confrontation between the parties during which Wren refuted the allegations.
It was also disclosed that when the report was made in 2005 against Wren, the victim had also reported about two other relatives who had raped her.
Those two persons were charged and the matter is still pending in the magistrate’s court. The two were charged separately from Wren.
During cross-examination by defence counsel, it was suggested that the victim who is now 20 years old was making up the story.
However the victim denied this. The attorney also suggested to the girl that there were problems within the family, however again the victim denied.
Thompson also asked whether the victim was having difficulty with answering questions, but the young girl said it was not that she was having difficulty, but remembering the episode was very painful.
The victim’s father was called upon to testify. He tendered a birth certificate. Police woman Roxanne Forde also testified and tendered a medical report.
Police constable Yohan Henry, who took the report back in 2005, was also called to the witness box. The matter is continuing today.
Only last week Justice Patterson sentenced 58-year-old Tyrone Mortley, of Bee Hive, East Coast Demerara, to fifty years imprisonment on two counts of carnal knowledge after he was found guilty by a mixed jury. The two 25-year sentences will run concurrently.
