Rawleston Cummings, the security guard accused of killing Lloyd Kandasammy back in 2006, has pleaded guilty to the lesser count of manslaughter.
On Monday the incident was recalled in court before Madame Justice Roxanne George Wiltshire, with Prosecutors Konyo Sandiford and Zamalla Ali representing the State. Cummings is being represented by Attorney at law Adrian Thompson. The accused had pleaded not guilty to murder, but changed this on Tuesday when the prosecution was ready to proceed with the matter.
The man later pleaded guilty to the lesser count of manslaughter.
The prosecution’s case was that the victim had dropped his wife to work on March 25, 2006 and had gone back to her workplace shortly before noon.
His wife, during his visit, had indicated that she wanted something to eat so Kandasammy left to get something. The man ended up at the Church’s fast-food restaurant on Camp and Middle Streets.
Kandasammy was driving his Green Toyota wagon car. The man went into the restaurant and the facts stated that an argument ensued between Kandasammy and one of the staffers.
He was eventually asked to leave the restaurant and he complied. The two security guards were outside of the restaurant speaking. According to the prosecution the defendant walked over to the passenger side of the victim’s car and shot him.
The defendant in his statement said that the victim had threatened to run his vehicle into the restaurant and him.
However the prosecution was ready to argue that it was not an act of self defence. This newspaper was told that when the incident took place an off duty police officer was nearby the scene and was able to arrest Cummings after he tried to escape.
Sentencing has been fixed for September 22. A probation report was also ordered into the matter.
