Treason PI continued

The preliminary inquiry into the treason charges against Major Bruce Munroe, his wife Carol-Ann, and former reserve officer Leonard Wharton, continued Thursday before acting Chief Magistrate Priya Sewnarine-Beharry at the Georgetown Magistrates’ Court.
The Chief Magistrate had given the prosecution 14 days to produce the tapes they hold as evidence so that she could determine if the evidence is material enough for her to rule.
However, the court was made to understand that the Director of Public Prosecutions did not hand over the tapes, but instead made an application for the Magistrate to revise her ruling.
On the last occasion, Magistrate Beharry maintained her ruling and made an attempt to listen to the tapes but could not hear what they contained since the instrument that would permit her to hear was missing.
As a result the witness was asked to return to court with the tapes and the instrument that is needed for her to get audio.
At Thursday’s hearing, the court learnt that Mrs. Beharry has heard the tapes, however, she stated that the tapes must be reviewed against the transcripts and the witness’s evidence before she can rule if the evidence produced in the tapes is material enough.
The Magistrate stated that the defence counsel will be made aware of the case they have.
The matter was then set for continuation on September 8 and September 14.
Defence counsel Gregory Gaskin and George Thomas, and Director of Public Prosecutions, Shalimar Ali-Hack, were all present at yesterday’s proceedings.
Wharton, a reservist in the Guyana Defence Force; Munroe, a serving major in the army and his wife Carol-Ann, were on December 27, last, arrested and charged with conspiracy for treason.
It is alleged that between December 1 and December 16, 2010, the three accused allegedly plotted to level war within Guyana to force the President out of office in order to compel the government to change its measures.
The trio first appeared in court on December 28, last. Treason is a capital offence which is not bailable.
