Guyana’s Director of Sport willing to work with GCB

The Berbice Cricket Board (BCB) has filed an injunction against the newly elected Guyana Cricket Board (GCB) claiming that the Executives were elected unconstitutionally. According to the BCB there was no quorum at the AGM at which the election of Office bearers was the final agenda.
Applying for the injunction was Angela Haniff, in her capacity as Secretary of the Berbice Cricket Board, a constituent member of the Guyana Cricket Board, and a Delegate of the Berbice Cricket Board at the Annual General Meeting of the Guyana Cricket Board held on the 10th July, 2011.
The Defendants are:- Ramsey Ali, in his capacity as the purported President of the Guyana Cricket Board.; Fizul Bacchus, in his capacity as the purported Vice-President of the Guyana Cricket Board; Alfred Mentore, in his capacity as the purported Vice-President of the Guyana Cricket Board; Anand Sanasie, in his capacity as the purported Secretary of the Guyana Cricket Board; Dru Bahadur, in his capacity as the purported Assistant Secretary of the Guyana Cricket Board; Anand Kalludeen, in his capacity as the purported Treasurer of the Guyana Cricket Board; Colin Europe, in his capacity as the purported Chairman of the Competitions Committee of the Guyana Cricket Board; Troy Mendonca, in his capacity as the purported Marketing Manager of the Guyana Cricket Board; Terrance Holder, in his capacity as the purported Public Relations Officer of the Guyana Cricket Board; Rayon Griffith, in his capacity as the purported Chairman of the Senior Selection Panel of the Guyana Cricket Board; Nazimul Drepaul, in his capacity as the purported Chairman of the Junior Selection Panel of the Guyana Cricket Board; Chetram Singh, in his capacity as a purported Trustee of the Guyana Cricket Board; Lionel Jaikaran, in his capacity as a purported Trustee of the Guyana Cricket Board.
Haniff said she was advised by Mr. Mohabir Anil Nandlall and Mr. Manoj Narayan, Attorneys-at-Law, and do verily believe that as a result of what she claims are violations of the constitution of the Guyana Cricket Board, the Annual General Meeting and election of office bearers are unconstitutional, unlawful, illegal, ultra vires, null, void and of no effect.
Haniff is claiming the following reliefs: (i) a Declaration that the purported Annual General Meeting of the Guyana Cricket Board held on the 10th day of July, 2011, at the Georgetown Cricket Club Pavilion, Chanderpaul Drive, Georgetown, is unconstitutional, unlawful, illegal, ultra vires, null, void and of no effect;
(ii) a Declaration that the purported election of office bearers which took place at the alleged Annual General Meeting of the Guyana Cricket Board held on the 10th day of July, 2011, at the Georgetown Cricket Club Pavilion, Chanderpaul Drive, Georgetown, at which the Defendants were elected, is unconstitutional, unlawful, illegal, ultra vires, null, void and of no effect;
(iii) an Order removing the Defendants from the purported offices to which they have been allegedly elected;
(iv) an injunction restraining the Defendants by themselves, their servants and/or agents and each and every one of them from holding out themselves as officers or representatives of the Guyana Cricket Board or in any manner whatsoever acting on behalf of or for or as the Guyana Cricket Board or performing any functions in relations thereto;
(v) costs; (vi) such further or other reliefs the Court deems just and reasonable.
In the circumstances, she sought the following Order:
(i) an interim injunction restraining the Respondents/Defendants by themselves, their servants and/or agents and each and every one of them from holding out themselves as officers or representatives of the Guyana Cricket Board or in any manner whatsoever acting on behalf of or for or as the Guyana Cricket Board or performing any functions in relations thereto;
(ii) such further or other reliefs the Court deems just and reasonable.
Haniff said that they would suffer irreparable harm and damage if the injunction sought is not granted give her solemn undertaking that if the injunction sought is subsequently determined to have been wrongly granted, “I will compensate the Respondents/Defendants in respect of all or any damages/costs they may have suffered as a result of the grant of the said injunction.
“That I am the owner of moveable property valued in excess of two million dollars located at Lot 20-3 St John Street, New Amsterdam, Berbice, Guyana, and I therefore have the financial means and capability to honour and make good my aforesaid undertaking,” Haniff said.
The constitution of the GCB states that at least two members (County Boards) and a minimum of 12 delegates must be present at the AGM to form a quorum.
Haniff informed that only David Blacks and Carol Nurse were at the AGM as legal BCB delegates along with the nine from the Essequibo cricket Board.
A source who attended the meeting claimed that more than two BCB delegates were present at the AGM but they then declined to exercise their right to vote at the elections which was a part of that meeting. A legal source told Kaieteur News last evening that the elections were legal.
Director of Sports Neil Kumar told Kaieteur Sport that while there will always be disappointment at any elections if those who you would like to win don’t, he recognized the GCB elections as fair and promised Government continued support for cricket in Guyana and was willing to work along with the new GCB for the development of Guyana’s cricket.
The Regional Under-19 series is presently being played in Guyana and it is unclear if the injunction is granted what will transpire with running for the youth series and if the WICB will still be willing to have Guyana host the Regional Senior 50-overs competition in October or the female Twenty20 Internationals between Pakistan and West Indies set for September.
The GCB elections was set for January this year but was delayed due to several reasons including an investigation by the Friendly Societies concerning the financial running of the GCB.
