Chief Justice Ian Chang yesterday ruled that the Bissoon Singh led faction of the Demerara Cricket Board (DCB) was illegally registered under the Friendly Societies Act.
The court deemed that the DCB led by Bissoon Singh did not have sufficient members since the laws of the Friendly Societies Act states that an entity must have at least seven members before it can be registered.
The DCB has only four members (East Coast Cricket Board, Georgetown Cricket Association, East Bank Cricket Board and West Demerara Cricket Association).
Attorney-at-Law Ronsdale Forde yesterday explained that the decision was also influenced by the fact that the Registrar refused to take into consideration that another DCB was already in existence and that having two DCBs could cause confusion in the minds of the public.
Another legal source informed that since the Guyana Cricket Board (GCB) only has three members (Demerara Cricket Board, Essequibo Cricket Board and Berbice Cricket Board) the GCB is also illegally registered and cannot be considered a legitimate part of the Friendly Societies.
It was explained that a decision to change the constitution of either the DCB or GCB regarding what constitutes a member can only be done at an Annual General Meeting. Well informed sources insisted that this was not done at either DCB or GCB level.
The Friendly Societies Act has been in existence long before Guyana gained Independence in May 1966 and some local Sports Administrators claim that the Laws of the Society are outdated and does not cater for modern sporting organisations.
The GCB elections, due since January is currently on hold due to investigations being conducted by the Friendly Societies Act which falls under the portfolio of the Ministry of Labour and Human Services.
Forde also informed that Justice Bovell Drakes had earlier restrained the Bissoon Singh faction from performing any role of the DCB or ‘holding themselves out as executives’ of the DCB.
The Bissoon Singh faction was challenging the Raj Singh led DCB for the rights to legally administer cricket in Demerara. The Raj Singh side sees yesterday’s court ruling as victory for their team as they prepare to continue their job of ‘running cricket’ in Guyana’s smallest but most populated county.
