The case of witness tampering against embattled television owner, Chandra Narine Sharma and his five associates Ravi Mangar, Tyrone Ali, Mark Reid, Raywattie Ramsaywack and Doodnauth’ was scheduled for continuation yesterday.
But unfortunately for the defendants, the matter was adjourned until March 18, due to the absence of the Magistrate.
Kaieteur News was made to understand that Magistrate Geeta Chandan-Edmond, who is presiding over the matter, was reportedly carrying out judicial duties at the Reliance Magistrates’ Court in Berbice at the time. As the defendants reported for their case hearing at Court #10 of the Georgetown Magistrates’ Court, they were informed by the court clerk about the Magistrate’s absence and were given the new date for the continuation of their trial.
Sanjeev Datadin who is prosecuting the matter was also absent as was the defendants’ attorneys, defence counsel Nigel Hughes and Mark Waldron. Datadin, Hughes and Waldron were informed about the non-hearing prior to yesterday’s date.
At the last hearing, Hughes tendered a letter informing the court that Sharma was granted permission by the High Court to leave the jurisdiction.
The letter which was tendered stated that Sharma will have to travel overseas urgently, so as to receive cardiac pacemaker implant and will be admitted to the hospital for two to three weeks. During that hearing Sharma was absent.
Yesterdays hearing was for an update on his medical condition.
During the cross-examination of one of the witnesses, at the earlier hearing Hughes told the court that due to the proceedings currently engaging the Supreme Court, the Magistrate court had no jurisdiction to entertain the submission by the prosecutor. He explained that the court should only proceed if the Magistrate found the action frivolous and vexatious.
Prosecutor Datadin at that point interjected and told the Magistrate that he does not see why the case of witness tampering which is before her should be halted as a result of the motion which is engaging the attention of the High Court.
The six accused were all charged with obstruction of justice on April 23 last.
That charge arose from the previous allegation against Chandra Narine Sharma of carnal knowledge of a girl under 12 which he was facing.
