“I can’t ever remember a defendant coming before me and saying prison has actually been beneficial to him,” said Justice Winston Patterson, minutes before he sentenced Taijpaul Nankishore called ‘Fat Boy’ who pleaded guilty to manslaughter.
The defendant was accused of killing his brother Seepaul Nankishore, on May 7, 2008. Taijpaul Nankishore had pleaded guilty to the lesser charge of manslaughter when his matter came up.
State Prosecutors Konyo Sandiford and Judith Gildharie-Mursalin, on behalf of the Director of Public Prosecutions, and the court had accepted the plea.
A probation report was ordered for the accused. Yesterday the report was submitted to the court by Senior Probation Officer Floyd Rudder, who is attached to the Ministry of Human Services and Social Security.
The court was told that the accused did not have an ordinary childhood. The report also pointed out that Nankishore was not literate since he never attended school.
After the report was read to the court, Nahkishore’s lawyer, Ms. Clarissa Riehl, addressed the court. She pointed out that her client did not waste the court’s time and added that it was the first time that the matter had come to the High Court. Thirdly, the lawyer opined that her client has shown signs that he is becoming a productive person.
“He has become a self-taught artist since his imprisonment….,” she stated. At this point Ms Riehl offered to show the court a few of the defendant’s paintings.
Further, she said that her client cannot run away from the fact that he caused his brother’s death.
“He knows he did something gravely wrong and he has his entire life to live with that regret…..but we are asking the court to be lenient when handing down his sentence,” the lawyer said.
Very impressive
“Very impressive…..very interesting,” Judge Patterson said as he held one of several paintings done by Nankishore.
The Judge took into consideration the issues surrounding the case, noting that it was very commendable that Nankishore at an early age, together with his mother, had worked and taken care of his other siblings.
He described the defendant as a “victim of circumstances” further adding that he had no doubt that the accused regretted the entire incident.
“All the reports that the court received was in favour for you….so I have to be lenient on you,” said the judge.
He asserted that Nahkishore has shown signs of improvement and he was very honest to say that he had benefitted from being imprisoned.
According to the prosecution, the two brothers were gambling on the morning of May 7th, 2008, when the younger brother who lost the game and $60, snatched the money from his older brother and cuffed him in the process.
An argument ensued and during a subsequent scuffle, Seepaul Nankishore called Ramesh was killed by his sibling. He was stabbed with a broken bottle.
