Magistrate Adela Nagamootoo on Tuesday upheld no case submissions by the attorney for drug accused Travis Spencer and set him free when his case continued before her in the New Amsterdam Magistrate court.
This was after the main prosecution witness failed to show up and no exhibits were presented despite repeated efforts to procure them.
Spencer, of Stanleytown, New Amsterdam, was before the court on a charge of possession of narcotics for the purpose of trafficking allegedly. He was arrested with the drug on April 5, last year.
According to the prosecution the man was among other passengers in hire car HB 5816 which was stopped by police in the vicinity of the Berbice Bridge. A search was conducted and 2.272 kilograms of leaves, seeds and stems of the cannabis sativa was found in a black plastic bag said to belong to the defendant.
He had allegedly asked the police for a chance stating that it was just a hustle. He was arrested and charged.
In court, however, he pleaded not guilty was refused bail and incarcerated until he was set free by the court.
The lawyer in his submissions stated that since his client’s case saw only one officer testifying and that testimony was full of inconsistencies. The lawyer further submitted that his client had nothing to answer because; even the arresting officer did not give testimony in the matter.
No exhibit was also presented in court, despite the matter being called at least three times.
