‘D’ Division Commander refuses to return seized guns

Two licensed firearm owners have filed contempt proceedings against the Commander of ‘D’ Division for refusing to heed court orders to return their seized weapons.
In the first instance, Ramdyal Boodhan, a farmer of Zeelugt, East Bank Essequibo claimed in the contempt motion that the Commander received court orders in December to return his Maverick single barrel 12-gauge shotgun but failed to carry out the orders.
On December 15, the order was made by Chief Justice Ian Chang, quashing a decision contained in a letter dated August 19, 2010 which revoked Boodhan’s licence.
In the notice of motion, Boodhan through his lawyers, Anil Nandlall, Manoj Narayan and Euclin Gomes, also asked that the ‘D’ Division Commander be jailed for refusing to carry out the court order to return the shotgun.
In the second contempt proceedings, Shabbir Baksh, a businessman of Vreed-en-Hoop, West Bank Demerara, also claimed that his gun was seized but court orders granting the return of his weapon are being disregarded.
On December 3, an order was made by Chang and Justice Rishi Persaud, in the Full Court quashing his decision contained in a letter dated the July 13, 2009, revoking Baksh’s firearm licence on the grounds that the said decision was arbitrary and unreasonable, among other considerations.
Absolute orders were made by the court to have the Assistant Commissioner of Police ‘D’ Division, at Leonora, return  the .32 semi automatic pistol and pay $40,000 in court costs.
That case too was filed by the same lawyers.
