Dale Thomas and Sibby Sancho yesterday appeared before acting Chief Magistrate Priya Beharry at the Georgetown Magistrates’ Court charged with possession of 2.377 kilograms of marijuana and 58 grams of cocaine.
To the charges Thomas pleaded guilty, while Sancho tearfully related to the court that she was innocent of the charges instituted against her.
She was represented by Deborah Backer.
Custom Anti Narcotics Unit (CANU) prosecutor, Oswald Massiah, told the court that on January 28, last, several CANU ranks acting on information, swooped down on a house at 59 David Street, Kitty, Georgetown.
The ranks then identified themselves and demanded that the occupants open the door but they were prevented entry.
As a result, some of the ranks surrounded the house while others gained entry through a glass door. Upon entering the house, Sancho was seen standing behind a bedroom door with her hands up while Thomas was observed sitting on the bed with a bag in his hand. The officers took possession of the bag and found a quantity of marijuana inside.
Further searches carried out in the bedroom unearthed a large amount of cocaine and marijuana under a bed.
As a result they were told of the offence and taken to the police station where they were both charged and placed into custody.
Massiah added that Thomas who was recently deported to Guyana told ranks that he forgot that the bag had cocaine inside.
Backer, in her bail application, told the court that her client is a mother of two minors and resides at 215 David Street, Kitty. She went on to explain that on the day in question, Sancho was just a visitor to the home.
The lawyer told the court that she is “happy” that the prosecutor mentioned that Thomas told them that he forgot the cocaine was also in the bag. The lawyer pointed out the fact that if Thomas forgot that the cocaine was in another bag how her client would have knowledge of the illegal substances.
With that she applied for bail in a reasonable sum.
Magistrate Beharry then questioned Thomas about the narcotics that were allegedly found in his home. The accused told the Magistrate that he was keeping the drugs for someone and is ready to take full responsibility of the consequences.
When asked if he had anything to say before sentencing was handed down, he mentioned “My worship I don’t want to waste the court’s time and I just want this thing to be over and done.” He was fined $30,000 each on the two charges and sentenced to four years each on both of the charges. His sentences will run concurrently.
However, bail was refused for Sancho and she will make her second court appearance on February 7, when three witnesses are expected to be called.
