Acting Chief Magistrate Priya Beharry refused bail to Ronald Da Silva who appeared before her charged with possession of a gun and ammunition without being the holder of a firearm and ammunition licence. The accused had pleaded not guilty.
It is alleged that on New Year’s Day, at Wai Wai, North West District, the police while patrolling the area of Big Hope, observed Da Silva walking along the road with a 12 gauge shot gun in his possession.
The ranks stopped him and inquired if he had a license for the gun he was carrying. Da Silva replied in the negative, which caused the ranks to carry out a safety precaution search. The lawmen subsequently unearthed eight 12 gauge-matching cartridges in Da Silva’s possession. He was told of the offence and arrested.
Da Silva who appeared nervous, said that he was carrying seven cartages instead of 12.
Police prosecutor Stephen Telford Objected to bail and requested that the matter be transferred to the Acquero Magistrate’s court.
Telford request was granted and Da Silva will make his next on April 5. Also charged with unlawful possession of gun and ammunition was Albert Prince of North West District Region One.
He too pleaded not guilty.
The court was told that on December 13, last at Wai Wai, Region One, the police conducted a search at a mining camp at Big Hope and unearthed one sixteen-gauge shot gun and one matching round under the mattress on which Prince was lying.
As a result he was asked to produce legal documents to show that he was authorized to have such items in his possession.
He was arrested after he failed to produce his gun and ammunition license.
The prosecutor also refused bail and the matter was transferred to the Acquero court for April 5.
Magistrate Beharry also denied bail to James Peters for the offence of unlawful possession of gun and ammunition.
He also pleaded not guilty and like Da Silva, was unrepresented.
The police are alleging that on December 31, last, in the North West District, they were visiting a mining camp at Big Hope owned by one Dalip Singh, when Prince walked into the dwelling area of the camp with a sixteen gauge shotgun and two sixteen gauge matching cartridges.
The lawmen then inquired from him if he was in possession of a firearm and ammunition license, he responded in the negative and got arrested.
He too will make his second court appearance on April 5, at Acquero Magistrate court.
