The case of witness tampering against Chandra Narine Sharma and five of his associates, Ravi Mangar, Tyrone Ali, Mark Reid, Raywattie Ramsaywack and Doodnauth came up again before Magistrate Geeta Chandan-Edmond, and the matter was adjourned until January 20, after both the state prosecutor Sanjeev Datadin and the defendants’ attorney Nigel Hughes were absent.
On the last occasion, Hughes told the court that due to the proceedings currently engaging the Supreme Court, the Magistrate court has no jurisdiction to entertain the submission by the prosecutor. He explained that the court should only proceeds if the Magistrate found the action frivolous and vexatious.
Prosecutor Datadin at that point interjected and told the Magistrate that he does not see why the case of witness tampering which is before her should be halted as a result of the motion which is engaging the attention of the High Court.
The prosecutor stated that there is no order from the High Court or any other court to prevent the hearing of the witness tampering case.
He added that if the accused felt that his rights of a fair trial is being violated then he should have made his intention known at the first instance of case hearing which is the layout procedure of the court.
He told the Magistrate that there is no evidence before her to prove that the defendants’ rights are being breached.
Sharma along with his son-in-law Ravi Mangar, Tyrone Ali, Mark Reid, Raywattie Ramsaywack and Doodnauth were all charged with obstruction of justice on April 23 last.
That charge arose from a previous allegation of carnal knowledge of a girl under 12 which he was facing.
The particulars of the charge read that Sharma willfully attempted to obstruct the course of justice by removing two of the girls at the centre of the allegations against him from their known address and taking them to a house at Golden Grove, East Bank Demerara, in order to prevent them from being questioned by the police in relation to the allegations.
