Dorestte Mc Cammon who was freed in the High Court in 2009 on a charge of murder committed on policeman Mica Cort on February 11th 2007, and then was freed again in early 2010 on a charge of robbery with violence which was pending since 2005, dodged another bullet last week.
This time he was freed of a charge of possession of narcotics for the purpose of trafficking.
The matter was dismissed by Magistrate Adela Nagamootoo in the New Amsterdam Magistrate’s Court after she upheld defence attorney Mursaline Bacchus’ no case submission.
Mc Cammon was charged with the offence on the 28th September.
It was alleged that he was found with 27 grams of marijuana, while being an inmate at the New Amsterdam Prison. Mc Cammon at the time was injured and incarcerated for the murder of Cort.
He was unable to walk and was in a wheelchair. The drug was found in a hollow section of the wheelchair. Attorney at law Bacchus had contended that the defense had no case to answer since the VC had never given evidence in the matter.
Bacchus submitted that Prison Officer Denhart had testified that he had found the drugs in a hollow section of the wheel chair and had given it to Officer Cossiah. But the Prosecution never called Officer Cossiah to testify as to what he did with the marijuana.
Instead they called the police detectives who conducted the investigations. In his summation, the attorney at law stated that the police’s nexus was broken, in that, there was no evidence that the substance that was given by Denhart to Cossiah was the same thing that was given to the police.
However, in his presentation, Prosecutor Corporal Roberto Figueira stated that the police would rely on the evidence of the case and stated that there is enough evidence presented. After listening to both sides the Magistrate concurred with the defence and set Mc Cammon free.
Mc Cammon still has a charge of possession of arms and ammunition pending in the Magistrate’s Court.
