Truck driver Chetram Moonsammy, of Johanna, Black Bush Polder, who was charged with 12 counts of causing death by dangerous driving on November 2, and who was refused bail when he appeared in the New Amsterdam Magistrate’s Court before Magistrate Adela Nagamootoo, was granted bail in the High Court by Chief Justice Ian Chang.
Attorney at law Kim Kyte-John filed the bail application on his behalf.
Moonsammy, 34, will now have to find $1.2 M, being $100,000 on each of the 12 charges.
The accused was charged with 12 counts of causing death by dangerous driving and one count of failing to render assistance.
It is alleged that on Friday, October 29, last, Moonsammy drove motor lorry GLL 8863 in a manner dangerous to the public, thus colliding with minibus BHH 1842, and killing 12 persons.
That information was sworn to by Sergeant Forbes Brown.
The prosecution had objected to bail on the grounds of the seriousness of the offence; that the defendant, if granted bail would flee the jurisdiction.
The offence was committed on the Number 19 Corentyne Public Road, Berbice, and the driver reportedly fled the scene without offering any assistance to the victims.
Attorney-at-law Mursaline Bacchus had appeared for the accused in the Magistrate’s court. He informed the Magistrate that the offence is a bailable one and that his client did not act recklessly and if he did, he would have been charged with manslaughter.
In her bail application, Attorney-at-Law Ms. Kim Kyte-John stated that the offence is a bailable one, that the cases may not be tried until the year 2012, and her client is innocent until proven guilty, and he has never been charged with any offence before.
She also argued that Chetram Moonsammy does not hold a current passport.
Moonsammy, at the moment, has more than 110 acres of rice ready to be reaped and if not reaped early, the entire crop will be lost.
