Magistrate Adela Nagamootoo yesterday freed two men accused of having in their possession 900 grams of marijuana for the purpose of trafficking.
The two Berbicians, Safraz Bacchus, 24, of Portuguese Quarters, Rose Hall, and Leroy Barry of Stanleytown, were both counting their lucky stars yesterday at the New Amsterdam Magistrate’s court after they were freed due to insufficient evidence.
The Magistrate noted that the prosecutor had failed to provide the court with hard evidence against the two accused. The court was told that on October 17, 2009, the police acting on information swooped down on a house at Stanleytown, Berbice.
As the lawmen were nearing the house, they observed two men fleeing into some nearby bushes. A search was carried out and the men were found and apprehended.
The officers later found a black bag which they have suspected to contained marijuana and an instrument used to weigh the substance.
After the content of the bag was weighed and tested, it was found to be 900 grams of marijuana.
Bacchus and Barry were subsequently placed before the court and charged.
The two accused both pleaded not guilty.
Bacchus at the time explained to the Magistrate that he was unfortunate to be at the said house, the day the police carried out the raid.
He stated that he was there to uplift some money that was owed to him by a man whose name he gave only as Wayne.
Attorneys at law Charrandass Persaud and Ramish Rajkumar appeared on behalf of the two accused and made an application for bail, which was denied.
In November, 2009, the men’s attorneys moved to the High Court and petitioned for bail, which was granted in the sum of $350,000 each.
At that time, Barry was unable to accumulate the said amount of money so he remained in police custody, while Bacchus was released.
