– lawyer claims wrong man charged
Attempting to commit a felony turned out to be a very costly act for 26-year-old Jermaine De Freitas of Lot 65 Castello Housing Scheme. Yesterday he made his first court appearance before Magistrate Hazel Octive-Hamilton and was granted bail in the sum of $300,000. It is alleged that De Freitas on August 4, attempted to rob Ling Sue.
He was not required to plead since the charge was indictable. His lawyer, attorney at law Basil Williams, in a bail application, said that charge against his client was speculative. The lawyer begged the court to observe his client’s injuries, which he claimed were inflicted by the arresting ranks.
“My client’s hand is broken…..because of the beating he sustained by the officers who arrested him,” Williams said. He asked that bail be set in a reasonable sum since his client has an unblemished record. The lawyer added that De Freitas was gainfully employed at his mother’s business establishment. Police Prosecutor Stephen Telford objected to bail, based on the seriousness of the offence.
According to the prosecutor, an identification parade was carried out and De Freitas was positively identified by the victim.
At this point, De Freitas’s lawyer interjected and stated that no offence was committed, thus making the “seriousness of the offence” irrelevant.
According to the lawyer, the police had mistakenly picked up his client on a murder charge, but after that could not be substantiated, they quickly instituted this charge on him.
Bail was eventually granted by the Magistrate. The accused was ordered to make his next court appearance on September 14.
