Two popular city businessmen, who allegedly obtained $3.6 M under the pretence that they could have obtained a motor vehicle for a man, were yesterday placed on $150,000 bail.
The men yesterday made their court appearance before Acting Chief Magistrate Melissa Robertson, at the Georgetown Magistrates Court.
Wayne Barrow, the proprietor of Versus Auto Sales, and Davenand Pooran who owns several businesses in and around Georgetown, were both accused of obtaining $3.6M from Aleemul Ali between November 24, last year, and March 5, last.
The charge further read that they claimed that they were in a position of acquire a motor vehicle for him.
They both pleaded not guilty. They were represented by Attorney at law Leslie Sobers.
The lawyer, in a bail application told the court that Barrow was 51 years old and resided at Lot 72 Queen Street, Kitty. Pooran, also 57 years old, resided at Lot 61 Atlantic Ville.
The lawyer opined that his clients should have been charged with frustration and breach of contract, instead of a criminal charge.
He added that the virtual complainant at no time could say that his client’s business place was not a reputable business entity.
Sobers further argued that the vehicle was already in the country but that his clients are having a difficult time with Customs.
“They were having troubles with the vehicle….so they gave him another vehicle to use in the mean time”.
The lawyer opined that the police should not have brought the matter to the Magistrates’ Court but to the High Court.
The lawyer asked the court to admit his clients to reasonable bail since they were not flight risks.
Police Prosecutor Stephen Telford objected to bail. According to the prosecutor, the two men received the money and the contractual time had elapsed. He said that the virtual complainant had all rights to draw his conclusion.
The Magistrate however granted bail to the men and ordered them to return to court on July 28.
