Acting Chief Magistrate Melissa Robertson, on Tuesday jailed a father of three to four years imprisonment, after he pleaded guilty to stealing his employer’s $5.2M Toyota Tundra pick-up, some three months ago.
It is alleged that Diyodhan Ramkirit, 24, of Vreed-en-Hoop Squatting Area, stole the vehicle (GKK 4274) – the property of Farouk Ghani of Peter’s Hall, East Bank Demerara. He pleaded guilty to the charge.
Three other persons, a man who allegedly bought the vehicle, another who is alleged to have forged the registration number, and a female who was charged with driving it with the false registration number, were all granted bail after they pleaded not guilty.
Oric Obermuller, 39, of Gaulding Place, South Ruimveldt, who allegedly bought the vehicle for $3M, was accused of receiving the stolen vehicle from Ramkirit on March 30, he pleaded not guilty.
It was further alleged that Obermuller on May 29 allowed 38-year-old Aileen Bowman, of Robb Street, Bourda, to drive the vehicle, knowing that the vehicle’s identification number was fraudulently inserted.
The magistrate then read a charge to Bowman which stated that on May 29, at North Road, she drove the vehicle knowing that the identification number (GKK 6438) was fraudulently being used and was not issued by the License Registration Office. She pleaded not guilty to the charge.
A third charge stated that Rakesh Sawh and Diyodhan Ramkirit between March 30 and May 29 with the intent to defraud, conspired with person or persons unknown to forge one certificate of registration to show that the vehicle was licensed. Sawh pleaded not guilty to the charge.
Obermuller and Bowman were represented by Attorney at law Vic Puran, while Sawh was represented by attorney at law Mishka Puran.
Attorney Vic Puran in his bail application said that Obermuller was a businessman. The lawyer explained that his client made himself available to the police, since the allegations were being made.
He said that his client was the “legitimate buyer” of the vehicle and had no knowledge that it was stolen. Puran further told the court that his client bought the vehicle from Sawh.
The lawyer said that Obermuller never had any brushes with the law and thus he should be admitted to bail.
Puran stated that the court must take into consideration that nothing was done to alter the appearnce of the vehicle. “My worship….the vehicle was not sprayed over nor was anything changed on the vehicle.”
With regards to Bowman, Puran said that the woman merely borrowed the vehicle from Obermuller to attend a function. He also asked the magistrate to admit her to reasonable bail, noting that she was married and a mother of two.
Attorney Mishka Puran then made a bail application on behalf of Sawh.
The lawyer told the court that Sawh was not a flight risk adding that he had no knowledge that the vehicle was stolen.
Police Prosecutor Stephen Telford said that he had no objections to the magistrate granting Bowman, Obermuller and Sawh bail.
With regards to Ramkirit, the prosecutor said that he was employed by the virtual complainant (VC), Farouk Ghani.
The prosecutor told the court that Ramkirit knew where the vehicle keys were kept. He said that on March 30, Ramkirit waited for the opportune time when his boss left and removed the vehicle which was parked in the garage.
The VC later returned and discovered that the vehicle was stolen, the matter was subsequently reported.
Telford said that during investigation the vehicle was located.
Ramkirit was later arrested and he admitted to the offence.
Before imposing sentence, the magistrate enquired from Ramkirit if he had anything to say. He told the court that he knew where the VC would normally keep the keys for the vehicle. The man said that after he stole the vehicle, he called Sawh and told him he had a vehicle from Suriname to sell.
“ Meh worship he ask me how much I want for it and I said $3M…..and he seh he can’t give me that,” Ramkirit recounted.
With tears streaming down his face, Ramkirit told the magistrate that he took the vehicle to Sawh two days after they negotiated a price.
He said that he received $300,000 from Sawh as an advance for the sale of the vehicle.
The man said that another man helped him to get the proper documentation for the vehicle.
He begged the magistrate to be lenient, “Meh worship ah begging yuh fuh leniency I gat three children….and a wife. I asking if yuh would be light on me”.
The magistrate subsequently jailed him for four years which would run consecutively.
