The management and staff of Fazia’s Fashions read with consternation and disappointment the contents of the libelous and prejudicial press release issued by the Ethnic Relations Commission (ERC) in relation to a complaint made to the ERC about an incident in which discrimination was alleged.
The management and staff of Fazia’s Fashion unequivocally deny the spurious allegations of discrimination leveled at our business whether by the ERC or anyone else.
Fazia’s Fashions have always and will continue to welcome customers of every description and persuasion to its businesses.
The company will however take such steps as are necessary to protect its commercial interests from commercial espionage and theft of its intellectual property.
The company has recently been the victim of elaborate commercial espionage
and theft of its intellectual whereby some of its competitors have resorted to the use and deployment of concealed cameras and other concealed recording devices which video and or electronically record our client’s exclusive designs and patterns which are then reproduced in inferior quality and passed off to the public as our client’s products.
As a result Fazia’s Fashions have restricted the use of cameras and other recording devices in their outlets.
On the 7th day of May 2010 Bishop Edghill along with four employees visited the Fazia’s Fashions where they commenced taking photographs in one of our stores.
The staff referred the photographers to the prominently posted sign which said No photographs or video recording allowed.
The Head of the ERC then accused the store of discriminating against Chinese people.
We denied the allegation and informed the Head of the ERC that we did not permit photographs to be taken in our business.
The head of the ERC then informed one of our managers that the business could be closed down.
The head of the ERC then invited one of our managers to the Commission.
The manager in order to avoid losses to the business as a result of the public spectacle created by the head of the ERC agreed to accompany the head of the ERC in his vehicle to the Commission’s offices.
During the interview by the head of the Commission, inquiries were made of the religious persuasion of the manager.
On the 17th day of May 2010 we received a letter from the ERC which referred to a complaint allegedly made by Ms Melanie Mc Turk on the 12th May 2010, a date after the visit by the head of the ERC.
We retained the services of our attorneys Hughes, Fields & Stoby who responded to the ERC’s letter requesting details of the alleged complaint.
The ERC responded on the 21st May 2010 enclosing a copy of the complaint and referring to an investigation which was allegedly conducted by the ERC.
The letter from the Commission promoted the head of the Commission act as a mediator as he had special skills in this area.
On the 27th day of May 2010 our Attorneys at law responded to the letter from the ERC in which it pointed out that the ERC could not purport to perform the functions of investigator, be a witness in the investigation while at the same time purporting to be a mediator. This would lead to a conflict of interest and the potential for real bias.
The subsequent publication of the prejudicial and premature report by the ERC before Fazia’s Fashions have been heard on the allegation of bias demonstrates the extent to which the capacity of the ERC to fairly adjudicate in this dispute has been irreparably impaired.
We condemn the manner in which the ERC has conducted themselves and are willing ready and able to attend any properly constituted objective inquiry in any allegations of discrimination.
