…charged with possession of arms and ammunition
Dorsette Mc Cammon who was freed in the high court in 2009 on a charge of murder stemming from the shooting death of police man Mica Cort on February 11, 2007, on Monday had a charge of robbery with violence dismissed by magistrate Adela Nagamootoo.
The charge had been pending since 2005. The magistrate upheld no case submissions by defence attorney Mursaline Bacchus, after the Prosecution was forced to close its case. Prosecutor, Inspector Satrohan Dayaram, had informed the court that they were unable to contact the main prosecution witness, Mark Yearwood, who is also the virtual complainant in the matter.
Yearwood had failed to show up on numerous occasions to testify in the matter.
Attorney at law Bacchus had contended that the defence had no case to answer since the complainant had never given evidence in the matter.
Mc Cammon was accused on Wednesday December 21, 2005, at Angoy’s Avenue, while being in company with others and armed with a gun robbed Mark Yearwood of $10,000.
Also today Attorney at Law Mursaline Bacchus informed the court that he would file a motion in the High Court to have the possession of arms and ammunition charges against his client dismissed.
Mr. Bacchus is contenting that his client had a charge of murder dismissed previously in the high court. He said that in that case evidence was lead regarding possession of arms and ammunition which was deemed unsatisfactorily, because the prosecution star witness in the murder case had testified that a particular policeman had taken possession of the gun used and that policeman never came to testify and at the same time another witness testified that he picked up the gun from the ground.
The lawyer further said that there was conflict because the prosecution was speaking about two guns and the ballistic expert gave evidence pertaining to one gun.
He is further contending that the issue of possession of a gun and ammunition was already determined.
He is expected to file the motion in the high court in two weeks to prohibit the prosecution from proceeding with the case.
