The Guyana Revenue Authority (GRA) is claiming that the Mayor and Town Council of Georgetown failed to hand over $24.6 million which was deducted from the salaries of employees over a four-month period last year.
As a result, the GRA is suing the municipality for the sum it was supposed to remit to the Authority. In addition, the GRA wants the Council to pay $5.4 million in penalties for failing to remit the tax deducted, and a further $2.4 million as interest.
The Income Tax Act requires all employers to deduct taxes from the emoluments of their employees and for the employer to remit the taxes within 14 days after the end of each tax period.
According to documents filed in the High Court, City Council submitted the returns of deductions and other documents indicating the amount of tax it deducted from employees, but failed to hand over the money to the GRA despite several demands and reminders.
The total of $24.6 million is for income tax owing to the GRA for the period June-September, 2009.
The Income Tax Act imposes penalty and interest on the defendant where the defendant fails to remit the income tax deducted from their employees by the 14th day after the end of the tax period.
The City Council is required to appear before the High Court on June 16, 2010.
Deputy Mayor Robert Williams told Kaieteur News he heard of the matter for the first time yesterday but would not deny that the Council failed to remit the taxes. He said he is expecting report on the matter from the Treasurer and Town Clerk today.
Contacted, Town Clerk, Yonette Pluck-Cort, said she was trying to ascertain whether indeed the Council did not hand over the money to the GRA.
However, she said the Council was seeking to resolve the matter with the Revenue Authority before the court date.
