Dear Editor,
Mr. Michael Maxwell in his letter to SN regarding the award of contract to Synergy is absolutely correct. A contract is not awarded to the Lowest Bidder but to the Lowest, Responsive, Responsible Bidder.
To be deemed Responsive, the bidder must submit all of the information requested with the Bid, which in this case, includes the seven items listed in Mr. Maxwell’s letter, as follows: (1) large scale project experience in the past five years; (2) references and credentials; (3) details of equipment/machinery owned and needed; (4) sub-contracting of the use of equipment and machinery requires an agreement; (5) contractor’s financial and human resource capability to undertake the project; (6) resumes of principals; (7) contractor’s past experience and capacity to effectively manage a range of impacts on similar large projects consistent with World Bank Standards.
To demonstrate Responsibility, Synergy or any other bidder must satisfy the minimum requirements identified for each of the items listed above. In this case, I am not sure if such minimum requirements were published, but the document does indicate that bidders must demonstrate capacity to manage similar large projects consistent with World Bank Standards. We assume that the requested information was submitted and the GOG contacted references to confirm the information supplied, as is normally the case. However, based on Public Information, it does not appear as though Synergy has completed any similar projects, anywhere in the world, so it is difficult to see how they satisfy this condition. In response to questions, Mr. Motilall has indicated that Harza are the engineers for the Hydro Project, but that is not the question here. The question is, who is the engineer and who is the qualified contractor, on this designed/build road project.
