A 37-year-old man of Sheet Anchor Village, East Canje Berbice, who is accused of having sex with his 13-year old step daughter on two occasions, was remanded to prison by Magistrate Adela Nagamootoo when he appeared before her on two counts of having carnal knowledge of a minor.
Prosecutor Corporal Sherlock King told the court that during December 2009, the accused allegedly committed the act on the first occasion and repeated it on April 10 when he and the young girl were alone at home.
In opposing bail, King told the court that the nature, gravity and prevalence of such crimes must be taken into account.
He further submitted that there is the possibility of witness tampering since the accused and the teenager live in the same house. He also pointed out that there is the likelihood that similar acts could be repeated.
Attorney at Law Charrandass Persaud, who represented the accused, tried to assure the court that his client will return to face his trial if granted bail.
The attorney said that the accused has a fixed address, is gainfully employed as a pump attendant and fisherman and is the sole breadwinner of the house.
The man and the victim’s mother live together at the same address in a common law relationship and have six children together who are all minors.
The teenaged victim and another sibling from the mother’s previous relationship also live in the said house, and according to the attorney, his client takes care of them all.
Attorney Persaud asked the court to consider that the allegation was prompted by persons other than those in the household.
He told the court that it was the victim’s mother who retained him to fight the battle against her daughter.
“I was really between a rock and a hard place,” the lawyer told the court.
On the score of witness tampering, the lawyer stated that that is a nullity.
He informed that arrangements have been made by the victim’s mother for the child to reside with an aunt at Ross on the West Coast Berbice.
After listening to both sides the Magistrate remanded the accused to court until April 30.
