Birley Wilson, 50, of lot 34 South Ogle Railway Line, East Coast Demerara, is claiming that an injustice was done to him and his family following the dismissal of a traffic matter at the Sparendaam Magistrate’s Court last Tuesday.
The case stems from an accident involving his vehicle and another car in which he and three members of his family received injuries.
According to Wilson, on April 11, 2007, a car, PJJ 6680, owned and driven by Terrence Kirpaul slammed into his vehicle, PFF 352, which was parked on the road, East of Felicity, ECD, causing his wife, son and niece from the United States of America to be injured severely.
Wilson explained that he lost his right eye in the process and had to replace it with prosthesis in the US, while his wife Audrey had her left leg broken.
His two-year-old son Victor also sustained a broken foot while his niece who was hurled through the windscreen as a result of the impact had her left eye damaged.
Wilson told this newspaper that Kirpaul was eventually charged and the matter was called at the Sparendaam Magistrate’s Court one week after the accident.
He said that he has attended every court hearing since the matter commenced, until its dismissal.
He further explained that Magistrate Yohannseh Cave first presided over the matter but it was later transferred to Magistrate Judy Latchman who now presides at Sparendaam.
According to Wilson, throughout the matter no evidence was taken.
He added that on every occasion when the matter was called up, a date would be given and nothing else would be done although so many years have passed.
He questioned how the scale of justice could be balanced when he now has to live without one of his eyes and his family is made to punish because of the negligence of one driver.
“What is justice really?” he questioned.
The man revealed that he would like the Director of Public Prosecutions to investigate the case properly and inquire from the Magistrate why the case was never tried, and justice not delivered in the proper way.
