Kenneth Rotnella, 25, of Eccles East Bank Demerara and William Agard, 29, of 447 East Ruimveldt Housing Scheme were yesterday granted their pretrial liberty by Acting Chief Magistrate Melissa Robertson, at the Georgetown Magistrate’s Court.
It was alleged that Rotnella, on October 22, 2009, unlawfully attempted to extend a permit which was not authorised by law.
It was further alleged that between August 1 and September 30, last, he and Agard conspired with persons unknown to fabricate or falsify an extension permit to stay in Guyana.
They both pleaded not guilty.
Rotnella was represented by attorney at law Hukumchand, who, in his bail application, said that his client is an American citizen.
He explained that he was not a flight risk, nor would he interfere with witnesses.
The lawyer further said that his client was initially given a three-month permit, but it expired and he wanted to renew it.
He said that his client asked Agard about ways in which he could go achieve the extension. “My client genuinely believed that the people whom he had grown accustomed to would help him,” the lawyer argued.
The lawyer added that his client was merely a victim of circumstances, who subsequently complied fully with the police.
Agard’s lawyer in a bail application said that his client was a family-oriented individual who was hard working.
The lawyer added that there was no likelihood of him tampering with witnesses.
The prosecution did not oppose bail, but sought for the defendants to report to the police station every Monday.
Agard was granted $75,000 bail whilst Rotnella was granted $125,000.
