Magistrate Adela Nagamootoo on Monday sentenced Arlington Layne, 34, of 42 Stanleytown, New Amsterdam, Berbice, to three months in jail after he pleaded guilty on two charges of assault and disorderly behaviour.
Layne who claimed to be a ‘Plantain Chip and Nut vendor’ on January 14 assaulted his reputed wife Stacy Johnson at his Stanleytown home. He also on the same day while in custody at the Central Police Station behaved disorderly.
Police prosecutor Fizal Karim Baksh stated that Layne and Johnson were living together with their only child. He said on the day in question, Johnson was at clinic when she received a telephone call from the accused requesting her to go to his place to collect some things for the child.
She complied and upon reaching the home there was a confrontation between the two where he cuffed and kicked her about the body.
Baksh said a report was made at the station and he was arrested and charged. He added that while in custody, Lane began to misbehave and use expletives and was warned to desist, but continued and was subsequently charged for the offence.
Layne then begged for mercy telling the magistrate it was a little misunderstanding. He said that he had received two barrels, but told Johnson that things would come for her and the child in a third barrel which is expected shortly. He declared it was that misunderstanding that brought up the argument. He claimed that he had never beaten her, but gave her a few slaps now and again.
Layne declared to the court that he and his ‘child mother’ are still together as he begged her forgiveness.
Contrary to what was said by Layne, Johnson related a different tale of her being abused by him. She stated that he even threatened to kill her, stating that “if he can’t get me nobody can’t”. She added that they have been separated since November.
The magistrate subsequently imposed the sentence of three months for assault and a fine of $10,000 or a further 20 days in jail on the disorderly behaviour charge on Layne.
As the magistrate was handing down the sentence, Layne was heard begging Johnson to forgive him and not to allow him go to jail. “Ow babes this is wha’ it come to now, this is what you gone do to me girl?” was his cry as he was being led away.
