A Brazilian national, who is unable to speak English, was yesterday remanded after making a court appearance before Magistrate Hazel Octive-Hamilton.
Bernardo Costa Silva Filho, 31, of 105 Campbell Avenue, appeared in court to answer a charge of possession of ammunition.
It is alleged that on December 21, last, at Lethem he had in his possession a 12 gauge cartridge without being the holder of a firearm license. He was represented by attorney at law Glenn Hanoman and pleaded not guilty.
Hanoman in an application for bail for his client said that his client’s travel document has been lodged with the police.
He added that his client would suffer a disadvantage since he is unable to speak English.
However, he stated that his client give a statement declaring that the ammunition was not his. He added that the ammunition was not found on his client but in a bag attributed to him.
Police prosecutor Shellon Daniels objected to bail on the grounds that bail for this offense is only granted for special reasons relating to the offense and not the offender.
After a long dispute between the Magistrate and the prosecutor as to why the statement was not filed, a policeman who brought the prisoner to court stated that the statement was not one under caution but just a normal statement.
The Magistrate then remanded the accused and he is to return to court on March 9, 2010 at the Lethem Magistrates’ Court.
