Magistrate Priya Beharry yesterday remanded Mohanram Dolai, one of the policemen ensnared in allegations of the torture of a teenager at Leonora. The other, Narine Lall, who was absent from court was excused and will later appear to be read the charge for torturing the teenager.
However, Corporal Oswald Foo, was named as the third accused and linked to the earlier charges slapped against Dolai and Lall when they made their first court appearance. Foo was again absent from court yesterday.
Sergeant Narine Lall, 38, who resides at the Leonora Police Compound and Police Constable Mohanram Dolai, 30, of 101 Meet-Meer-Zorg, were jointly charged for unlawfully wounding the teenager, on October 28 at Leonora Police Station.
Corporal Oswald Foo along with Dolai and Lall were jointly charge for unlawfully wounding to Deonarine Raffi.
It is alleged that on October 28 at Leonora West Coast Demerara the three unlawfully and maliciously wounded Deonarine Raffi with intent to maim disfigure or cause grievous bodily harm.
It is further alleged that on the same day at Leonora, Dolai and Lall, unlawfully and maliciously wounded the teen with intent to maim disfigure or cause grievous bodily harm. Both charges were indictable so no pleading was allowed.
However, their attorney Hukumchand asked for the Administration of Justice Act to be applied. The prosecution objected. Hukumchand who represents Dolai and Lall also explained Lall’s absence from the court yesterday. He said that his client was informed late on Monday to report to a certain office so he was unable to attend court yesterday.
He said that they were told that they were going to be charged for the teenager yesterday. He added that an investigation is going on for two charges previously read to Dolai and Lall.
He asked that they be sent on their own recognisance since they were granted bail by the High Court for the two charges previously read to them. The magistrate then explained that they were being read a new charge which involved the teenager.
She added that Foo is now being added to the charge in relation to Deonarine Raffi. She then asked the prosecution why is Foo now being charged when he should have been charged from the inception.
Police Prosecutor Stephen Telford said that the first charge for Raffi’s torture should be withdrawn so as to allow the new charge to be instituted to all three.
Hukumchand intervened and applied that the bail previously granted to his clients be reinstated to the new charges if the old one which involves Raffi is to be withdrawn.
Hukumchand in his bail application said that all the charges read to his clients are all related to the same incident. He added that there is no likelihood of his clients recommitting the acts or of them absconding. He added that the High Court granted them bail since the charges were all related.
Magistrate Beharry refused to grant Dolai bail and told Hukumchand she will reconsider bail on November 30 when Lall, along with Foo, is expected to return to court.
