NEW AMSTERDAM, BERBICE – In excess of 600 Berbicians have received assistance from the Guyana Legal Aid Clinic in Region Six, since the organisation opened its door in October 2008.
Heading the office is Attorney-At-Law Ian Anamayah, who hails from a family of lawyers; his father, Joseph Anamayah, and brother Adrian Anamayah are both in the profession.
He lauded the Government of Guyana, the Minister of Human Services and Social Security as well as the legal aid family for extending their arms to embrace Region Six.
So far, 85 percent of those who sought help were women. According to Mr. Anamayah, he is satisfied with the progress made thus far despite limited resources.
The office is located in the compound of the Regional Democratic Council in New Amsterdam.
At present, the Bar Association in Berbice has only 17 attorneys and they service the entire East Berbice/Corentyne geographic location. The Legal Aid Clinic is one way of boosting efforts to provide the necessary social services to the under-privileged and to ensure these persons derive benefits from legal advice and representation.
Most of the legal issues involve complaints from women affected by domestic violence. But Mr. Anamayah noted that some women, who make use of the service, have a change of heart when it is time to take the matter to court,
“Whether it is out of fear or whatever reason they back out. We also find in many instances the family members have a lot to do with it; the in-laws may pressure the woman not to attend court or not to finish the matter.”
When reports are made in the case of domestic violence, advice is given to the client on the course of action and if necessary a possession order is sought to remove the abuser or aggressor from the environment.
The Magistrate may not readily grant the order sought without first exploring all circumstances or facts placed before him including the rights of the defendant. The Domestic Violence Act gives the Magistrate broad powers in terms of what he can do when it comes to the well-being of the abused and if children are involved. In the case of a restraining order against the male, the question of how to enforce it arises especially when he is living in the home. The women would often leave the dwelling place with or without the children.
Divorce and affiliation and all types of criminal and civil matters are dealt with except complicated land issues. At present, three persons are being represented in murder cases by the Region Six Legal Aid Clinic.
