Strategic Action Security Services has threatened legal action against the Government for a breach of contract, after Government announced the hiring of two other security companies to guard its facilities.
On Friday, Attorney-at- Law Mortimer Coddett, on behalf of the Strategic Action Security Services, wrote the Ministry of Local Government and Regional Development warning that attempts to remove or stop the guard service from the facilities will result in “prompt legal proceedings.”
On Friday also, the Ministry signed a $46M per month contract with R.K.’s Security for Government facilities in Regions Two, Three, Four, Five and Six while Homesafe Security will be providing security services to the tune of $14M monthly for Regions One, Seven, Eight, Nine and Ten. The contract comes into effect today.
In a comment on Saturday, Minister of Local Government and Regional Development, Kellawan Lall, noted that the contract with Strategic Action Security was for a year. There was a tender process and a new security company was selected. “If there is any aggrieved party, the matter can be addressed at the court level.”
Director of the Strategic Action Security Services, Richard Kanhai, declined to comment on the matter when Kaieteur News contacted him on Sunday night.
However, the lawyer in the letter to the Ministry claimed that his client still has a legal contract with Government for facilities in Regions Two, Three, Four, Five and Six.
In the letter addressed to Permanent Secretary, Seewchan, Coddett referred to a letter issued by the Ministry to Strategic Action Security Services in which the buildings being secured under the agreement must be handed over by November 15.
According to the lawyer, the contract that the security company signed with Government has clauses that allow the company to have an automatic renewal of the contract for a further period.
Strategic Action signed the contract last year on February 1 for a one-year duration.
The lawyer, in his letter to the government, pointed out that for all legal reasons, his client still has a contract.
According to the contract, “It is hereby mutually agreed between the parties that on expiration of the said term and the Contractor, having duly observed the stipulation on his part herein contained in this agreement not having previously determined, shall have a right to automatic renewal of contract for a further period.”
The lawyer also noted that based on the current contract, either party can terminate the arrangement by giving a three months’ notice.
“Take notice in the meantime my client will continue to perform his duties until such time as his contracts are properly determined. Take further notice that should you attempt to do otherwise than allow my client to continue, prompt legal proceedings will be taken.”
