Police, including traffic ranks, are not walking magistrates and should not engage in handing down judgement and demanding illegal favours for witnessing the law being broken, said Home Affairs Minister Clement Rohee, yesterday.
His comments came in the wake of abundant complaints to his Ministry. Rohee issued warnings to ranks that zero tolerance will be employed for such behaviour.
Sharing guidelines for the conduct of members of the police Traffic Department, the Minister endorsed a public advisory that states that ranks are not authorised to solicit motorists to provide any favours to them, including the supply of meals, cash or provision of anything not connected with the performance of their duties.
He warned that both parties would be liable for criminal charges for obstructing the course of justice. He said, “People have been complaining about such issues so we are sensitising while offering a deterrent to those ranks that might have ideas and are tempted.”
Amidst age-old complaints from drivers, Minister Rohee says ranks or members of the force are not authorised to take away a driver’s licence or other documents unless the driver fails to give his/her name and address or the documents are suspected to be forged or unlawfully obtained.
Even as the police continue to have issues of persons making complaints about ranks resulting in some ranks being taken before the courts, Minister Rohee said that the issue continues to be one where complainants don’t show up to follow through for fear of causing problems with the police.
He also noted that while some ranks have been issuing tickets for traffic offences, others are not, but he reminded that tickets are expected to be issued to errant drivers for minor offences and that in these cases, vehicles should not be detained.
In a public advisory, the Minister noted that junior traffic ranks should not detain vehicles at police stations for unnecessarily long periods of time without probable cause and the expressed authority of their superiors.
The Minister also reminds that traffic ranks are expected to be courteous to motorists and other occupants of vehicles and must at all times act impartial.
He is advising that complaints of misconduct of traffic ranks should be lodged with his ministry, the Police Complaints Authority, the Commissioner of Police, the Office of Professional Responsibility or with any Divisional Commander.
