An Essequibo Coast resident is crying fraud after a land he was willed by an uncle seems headed into the hands of another person.
According to Feezal Shaw, he was willed 26 South Half, Richmond Village, Essequibo Coast by his now deceased uncle, Shakir Ali.
Shaw is now challenging his cousin, Arnold Doobay, who is now purportedly in receipt of a Transport for Lot 3 South Half which is the same location as Lot 26, which is the original property given to Mr. Shaw.
In that will, Shaw was given 10 acres of rice lands supported by both house lots and land situated at Lot 26, South Half, Richmond Village, Essequibo Coast.
Lot 26, South Half according to the Neighbourhood Democratic Council and the Lands and Surveys office on the Essequibo Coast, does not exist except that the plot of land has a lot 26 north half.
Shaw told this newspaper that he has since probated his will [NO. 444] of Lot 26, through his attorney, Gaumattie Singh.
Shaw claimed that Doobay is laying claim to the said property with a purported transport which he was able to obtain from the Suddie Registry and bearing No#451\2008, mentioning Lot No#3, South Half and not Lot 26, South Half.
Shaw said that he found this out in January when he visited the NDC office at Anna Regina to make further payments of rates and taxes for the said property. He has been making these payments for the past four years.
Shaw has been making these payments of both rates and taxes for his deceased uncle Mr. Ali for the last four years. His uncle, Shakir Ali, who had willed him the property lived at the said address for the last 35 years and had been making payments during that time.
According to Shaw, in an arbitration hearing between Shakir Ally on the one part and Bibi Nariman Frienze representing Arnald Doobay by Power–of –Attorney No. 538\99 on the other part, it was ordered the title to Lot 93 La Belle Alliance be issued in the name of Shakir Ally.
Shaw said that the matter came to a head last week Friday when he was informed by his caretaker, John Danraj, that Doobay, who recently visited Guyana from Canada with a medical team and was on the Coast that day, took two police officers and simultaneously ordered his eviction.
According to Shaw, a notice board that was placed on the property was also removed illegally by Doobay, despite the police warnings.
Danraj said that Shaw hired him as caretaker of the same property for the past four years. He had been living there for the past 15 years with the late owner, Shakir Ali.
Shaw questioned the authority of the policemen in ordering such eviction. He called on the NDC to show what agreement Doobay used to claim the said Lot 26, South Half, with a purported transport for Lot 3, South Half. Shaw is also wondering if the NDC is superior to the High Court.
Kaieteur News, on contacting the NDC office, found that there were no records to show that Doobay was paying rates and taxes. However, it was clearly noted that Shaw who was entrusted with that responsibility carried out that duty for the last four years.
Further investigations revealed the Town Clerk was advised by Doobay to amend the changes in order for him to now carry out payments of rates and taxes to property Lot 3, South Half which both NDC and Doobay now claim and which on one transport is Lot 26, South Half.
