A.H.& L Kissoon has taken the Attorney General to court and is claiming $10M in damages following the much-publicized seizure of three CLICO vehicles on August 15, last. The company in an action filed Monday described Ramson’s action as “oppressive, arbitrary and unconstitutional”.
In a statement of claim, the company explained that it had received judgment against several insurance companies, including CLICO, for a fire at Park Hotel, Main Street.
The judgment was rendered on September 11, 2008, against CLICO, Hand-in-Hand Mutual Fire, North American Fire Insurance and the Guyana Cooperative Insurance Service Inc, for $146M with interest of six per cent from June 4, 2001 to date of judgment.
A.H.&L, however, agreed to accept four per cent which when computed, came up to almost $189M. CLICO’s share alone was $51M. According to the statement, all the insurance companies paid up except CLICO.
During December last year, a Writ of Execution was granted by the Registrar on all movable and immovable property of CLICO including motor vehicles bearing registration PJJ 2579, PKK 6472 and PKK 669. A.H.&L Kissoon moved to levy the execution and on August 15, last, a Marshall seized the three vehicles and lodged them at the High Court.
However, Attorney General Ramson issued a letter to the Registrar dated August 14 instructing him to return the vehicles.
According to the court documents the company contended that the conduct of Ramson was unlawful and malicious and “specifically intended to injure and did injure the plaintiff, alternatively the Attorney General acted with reckless indifference as to the consequences or injury to the plaintiff and is guilty of misfeasance in public office.”
According to the company, it suffered loss and damages as a result.
In the claim, A.H.&L Kissoon suffered a loss of opportunity to recover the $51M. An additional of $100,000 is being claimed for the removal of the vehicles and legal cost is also being claimed.
